Filter++ Privacy Policy
Preface:
Please note that this Privacy Policy is provided in English. Should you need its translation in any other language, please contact us. However, we cannot guarantee the availability of the language version you may request for. This Filter++ Privacy Policy is between you and Magical Dev. (hereinafter the “Company” , “We” or “Filter++” ), regarding users’ registration, login and use of Filter++. This agreement describes the Company’s and your rights and obligations related to the services of the APP. Filter++ reminds you to read this Privacy Policy carefully before using the product. By accessing or using Filter++ for iOS and Android, (collectively the "App") on mobile phones or other device (collectively, "Device"), you signify that you have read, understood and agreed to be bounded by this Privacy Policy and any other applicable law, whether or not you are a registered member of Filter++. Filter++ may change this Privacy Policy at any time without notice, effective upon its posting to the App.
Collecting information:
1. What you give us:
We collect your information you give us or permit us to access your information to make sure you can make full use of our services to you. What's more, we will be in accordance with the relevant State laws and regulatory requirements, in saving information users provided to us or allowed us to use. Information may include, but is not limited to, your location (GPS) information, name of the hotspot you connected to.
2. What we collect from you:
To deliver the functionalities of the Application in order toprovide you with better applications and services, we may need to collect the following data from you:
• Device Information. To provide better products and/or services and improve user experience, we will collect device attribute information (e.g. your hardware model, operating system version, device configuration, unique device identifier, signal strength, storage space, etc.), device location information (e.g. location information acquired via GPS or WIFI signal), device connection information (browser type, telecom operator, language) , device operating information (windows in background or foreground) and device status information (e.g. device sensor data, device application installation list). With regard to information collected from any of your devices, we might connect them so that we can provide consistent services for these devices. We might connect your device information or phone number with your Filter++ account for convenience of maintaining consistency of follow-up services.
• Identity information: we collect your account information of our product to maintain the process in backstage active.
• Location information: If you allow Filter++ to access location-based services via your mobile phone operation system, we will collect your device's precise location while the application is running in the foreground or the background of your device. This is for the purpose of preparing and pushing customized content for you. You can also choose to switch off the "positioning" function of your device, but this may affect the services provided by our application.
• Log information: When you visit our Websites and/or use our Application, we may process technical data via "cookies", such as your IP-address, visited webpages, the internet browser you use, your previous/next visited websites and the duration of a visit/session to enable us to deliver the functionalities of the Websites and our Application.
• Photos: Filter++ will obtain the permission to visit the photo album in your device when you use it to edit photos. We will not try to collect or store the photos neither before nor after your edition so far. But if you choose to share your photo(s) in the Filter++ community, we will collect and the photo(s) to display in the Filter++ community as well as store it(them) in the server of Filter++. Your choice as aforesaid will be deemed your permission for such collection and store by Filter++.
• Other: When you are a registered user of the app, download or use the applications Filter++ promotes, we may receive and collect your information, such as functions you have used, the operation you performed and your online time and frequency. This is helping to keep improving our services for you.
We provide you with the ability to access, rectify, port and erase your data. Learn more in Settings of Filter++.
Use of Data:
Including the reasons stated above, we may in addition apply the collected data for the following purposes：
• providing, maintaining and improving our services, including but not limited to new functions, customer support, security features, authentications of users, application updates prompt and message management;
• executing internal marketing campaigns such as preventing fraud and abuse of our related services, solving application errors and operational problems, performing data analysis, test and research, monitoring the operational status of the application;
• learning more about how you access and use our services, thus targeting to respond better to your individual needs, such us language settings, location settings, closely monitoring which features of the Service are used most anonymized and aggregated form, analyzing usage patterns and to determine where we should offer or focus our Service;
• Assess the effects of our ads and other campaigns, to modify the service, including provision of reference or recommendation, content, and advertising;
• Software certification or managing software upgrades；
• Allowing you to participate in surveys about our products and services.
Store and transfer of Data
We store data until it is no longer necessary to provide our product and services, after which they will be deleted. We share the Data internally within our Company. The data will be stored in our server in Singapore and be transferred to, or stored and processed in our Chinese headquarter for the purposes as described in this policy. These data transfers are necessary to provide the services set forth in the Filter++ to globally operate and provide our Products to you. We have applied the highest standards of protection measures to reduce the risk of information stolen during the transfer. The protection measures include but are not limited to HTTPS certification and encrypted process during the transfer. If you agree to this policy, you consent to these data transfers to China and Singapore.
Declaration to protect your privacy
Filter++ will not acquire nor process your private information, including, but not limited to, your identity, network access records, bank account and other financial information, except as otherwise provided in laws and this Privacy Policy. Filter++ shall not disclose or provide any of your information to third parties without your permission.
This Privacy Policy does not apply to any third party which provide you with services, including those who may be disclose data to Filter++.
Protecting users' privacy (especially juveniles) is one of our basic policy. Therefore, if parents (guardians) wish juveniles to use our service, they need to register and download application for their children on behalf of themselves. During the interview with the application and/or the service, they should judge as legal guardians weather it fits juveniles.
The Company does not assume the user the following risks (nevertheless, we will provide adequacy) IT protections:
（1）risks such as loss or leakage of personal information due to irresistible factors; and
（2）risks of revealing users' privacy when users use this software to visit third party Web sites, third party Web sites and associated risks that may lead to the disclosure of consumers ' privacy.
Sharing of information：
We may reserve, preserve or disclose your personal data under following circumstances:
• to comply with relevant laws and regulations;
• in response to requirements of the relevant government agency or law enforcement official;
• to comply with relevant laws and regulations regarding personal and property safety, to protect the public interest of other users and employees of Filter++.
Amendment of Privacy Policy:
Filter++ may change the Privacy policy, at any time without notice, effective upon its posting to the Platform. If there is a significant modification in this Agreement or change in the way Filter++ treat your personal data, we will inform you through certain services. We encourage you to periodically read this Privacy Policy, understand the latest information on our privacy practices. You shall immediately stop using the application if you do not accept the revised Privacy Policy.
Others
1.We solemnly remind you to pay attention to the provision of exempting the Company's responsibility and increasing the terms of your obligations. Please read carefully and consider the risks. Minors should be accompanied by the statutory guardian when reading the privacy agreement. Rights of final interpretation and modification of the provision mentioned above belong to the Company.
2.If any of the provision set out in this Privacy Policy being partly or wholly invalid, it shall not affect the validity of the other clauses.
3.To the interpretation, validity and dispute resolution of this privacy agreement the laws of the People's Republic of China applies, except to the extent overriding mandatory provisions of the country of your residence or of another relevant country apply. In case of any dispute or controversy between you and the Company, first of all this should be tried to be solved by friendly consultations. If no agreement is reached through consultation, you completely agree to deliver the disputes to the Beijing Arbitration Commission(“BAC”) in accordance with the Arbitration Rules of the Beijing Arbitration Commission ("BAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of arbitration shall be Beijing. The language of the arbitration shall be Chinese. The number of arbitrators shall be one. This clause will not prevent you from bringing the dispute to the forum competent further to the overriding mandatory provisions of the country of your residence or of another relevant country.
